South Dakota has a ban on texting and driving, but enforcement measures can be rather lenient. There is currently no law that bans the general use of hand-held devices while driving. That means drivers over the age of 18 are allowed to use hand-held devices while on the road.
Texting and driving is only a secondary offense. This means that drivers can’t be stopped simply for texting while driving. However, if they are stopped for another infraction and it was determined they were texting and driving, they can be cited.
