Does South Dakota Have Distracted Driving Laws?

Yes and no. Like 46 states nationwide, South Dakota bans all drivers from texting while driving statewide, according to statistics compiled by the Governors Highway Safety Administration. South Dakota's statewide texting while driving ban went into effect on July 1, 2014. Drivers who violate the law are subject to a $100 fine for texting while driving, according to handsfreeinfo.com.

In addition, South Dakota also has laws banning school bus drivers, driver's with intermediate driver's licenses and learner's permits from using a cellphone at any time while driving.

However, South Dakota does not have a statewide law banning hand-held use of cellphones while driving. Nationwide, 14 states have laws prohibiting drivers from using hand-held cellphones while driving, as of April 2017.
